ONLINE SHOP TERMS AND CONDITIONS — MARTAGALLERY.COM
§ 1. GENERAL PROVISIONS
- These Terms and Conditions define the rules for using the website https://martagallery.com and the terms of purchasing products offered by the Seller.
- The Seller is Marta Zawadzka, conducting business under the name MARTA ZAWADZKA MARTAGALLERY.COM, Świętokrzyska 30/55, 00-116 Warsaw, Poland, NIP: 9661556549.

- These Terms are made available on the Website in a form that allows their storage and reproduction.
- By using the Website, the User confirms that they have read and accepted these Terms and Conditions.
§ 2. DEFINITIONS
- Customer – a natural person, legal entity, or organizational unit placing an order via the Online Shop.
- Product – physical artwork offered by the Seller, including original paintings and fine art prints.
- Online Shop / Website – the website available at https://martagallery.com.
- Sales Agreement – a distance sales contract concluded between the Seller and the Customer via the Website.
- Order – a purchase request submitted by the Customer through the Order Form.
- Consumer – a natural person acting for purposes outside their business activity (EU definition).
§ 3. USE OF THE WEBSITE
- Browsing the Website does not require registration.
- The Customer may place orders with or without creating an account.
- The Website is available 24 hours a day, 7 days a week, subject to technical interruptions.
§ 4. PRODUCTS AND ORDER PROCESS
- The Seller offers physical artworks, including original paintings (“one-of-a-kind”) and limited edition fine art prints.
- All products available in the Online Shop are physical goods delivered to the Customer.
- Orders are placed via the Website using the Order Form.
- The Customer selects the Product, provides delivery details, and proceeds to payment using available payment methods.
- For certain unique artworks, availability, shipping details, or timelines may require individual confirmation prior to fulfillment.
- The Sales Agreement is concluded upon confirmation of the Order by the Seller via email.
§ 5. PRICES AND PAYMENT
- The primary currency of the Online Shop is USD (United States Dollar).
- Prices may also be displayed in other currencies (e.g. EUR, PLN) for informational purposes.
- The final price payable by the Customer is shown during checkout and includes the product price and delivery costs.
- The Customer may choose from payment methods available in the Online Shop.
- The Seller reserves the right to change prices; however, the price visible at the time of placing the Order is binding.
§ 6. DELIVERY
- The Seller delivers Products worldwide.
- Delivery is carried out via reputable courier services such as DHL, DHL Express, DPD or equivalent providers.
- Delivery costs and estimated delivery times are provided during checkout.
- For selected countries, the Seller may cover customs duties and import taxes.
- The Customer is advised to inspect the shipment upon delivery and report any damage immediately.
§ 7. RIGHT OF WITHDRAWAL (RETURNS)
- A Consumer has the right to withdraw from the Sales Agreement within 14 days from the date of delivery without giving any reason.
- To exercise this right, the Customer must notify the Seller via email at [email protected].
- The Product should be returned in its original condition and packaging.
- The Customer is responsible for any diminished value resulting from use beyond necessary inspection.
- Refunds will be processed within 30 days from receipt of the returned Product.
- Refunds are issued using the same payment method used by the Customer unless otherwise agreed.
§ 8. COMPLAINTS
- The Customer has the right to submit a complaint regarding defective Products or improper service.
- Complaints should be sent to [email protected] and include a description of the issue and relevant details.
- The Seller will process complaints within 30 days.
§ 9. TECHNICAL REQUIREMENTS
- Use of the Website requires an internet connection and a web browser supporting modern web standards.
- The Seller is not responsible for technical issues on the Customer’s side.
§ 10. NEWSLETTER
- The Newsletter service is optional and free of charge.
- The User may unsubscribe at any time by contacting the Seller or using the unsubscribe option.
§ 11. COPYRIGHT
- All content on the Website, including images and text, is protected by copyright.
- Any use without prior written consent of the Seller is prohibited.
§ 12. PERSONAL DATA AND COOKIES
- Personal data is processed in accordance with applicable laws, including GDPR.
- Detailed information is available in the Privacy Policy on the Website.
§ 13. FINAL PROVISIONS
- Polish law shall apply to these Terms and Conditions.
- Consumers have the right to use out-of-court complaint and redress mechanisms, including the EU ODR platform.
- The Seller reserves the right to amend these Terms; changes do not affect orders already placed.
- In matters not regulated herein, applicable legal provisions shall apply.
